Subject: APPEALS – Borris McIntosh (TRAINER) and Carl Campbell (Groom) vs. First Instance Tribunal

On Tuesday July 6, 2021, the Commission heard appeals submitted by Trainer, Borris McIntosh and groom Carl Campbell against the decision of the First Instance Tribunal in relation to the positive finding of the drug, Lidocaine (A class 2 substance) retrieved from a sample collected from horse Bullet Raj on the 8th July 2019.

After carefully reviewing the evidence, and submissions made by Mr. Douglas Thompson, Legal representative of Mr. McIntosh and Mr. Campbell the Commission’s legal representative, Mr. Garth McBean QC, the Commission ruled that the appeals of Trainer Borris McIntosh and Groom Carl Campbell be allowed and that the penalties of Two Hundred and Fifty Thousand Dollars ($250,000.00) each imposed by the First Instance Tribunal be set aside. The disqualification of horse Bullet Raj from the race in question was also set aside.
The appeals were allowed as the Commission accepted the submission of the Attorney-at law for the Trainer and Groom that there was insufficient evidence of the Supervision of the collection and transmission of the urine sample in question.
